Services

The success of an Insolvency Professional in the Corporate Insolvency Resolution Process (CIRP) is intrinsically linked to the identification and onboarding of a Resolution Applicant who can maximize stakeholder value while ensuring the Corporate Debtor remains a going concern. Such a resolution not only fulfills the objectives of the Insolvency and Bankruptcy Code but also brings critical relief to workmen, employees, and other stakeholders.

To support this crucial function, ESM has constituted a dedicated and well-trained team entrusted with the following key responsibilities to assist Insolvency Professionals who are partners of ESM:

  • Business Assessment: To conduct a detailed analysis of the Corporate Debtor’s business operations, including its financial health, asset and liability profile, production capabilities, product and service offerings, input supply chain, customer base, fixed and variable cost structure, and overall commercial viability.
  • Industry and Market Data Compilation: To gather, maintain, and regularly update databases related to various industry segments in order to identify and assess potential Prospective Resolution Applicants (PRAs).
  • Preparation of Marketing Collateral: To prepare brief profiles (teasers) for dissemination among entities that may have strategic or operational synergy with the Corporate Debtor, including High Net-Worth Individuals (HNIs), institutional investors, investment funds, Asset Reconstruction Companies (ARCs), and other relevant stakeholders.
  • Lead Generation and Development: To identify, track, and engage with potential Resolution Applicants, facilitating their evaluation of the Corporate Debtor and providing all necessary data and clarifications required for the formulation of a compliant and competitive Resolution Plan.
  • Stakeholder Engagement: To conduct meetings and interactions with Prospective Resolution Applicants, ensuring transparency and providing the necessary confidence and assistance to encourage the submission of Resolution Plans.
  • Site Visit Facilitation: To coordinate and manage inspection visits of Prospective Resolution Applicants to the Corporate Debtor’s operational sites, ensuring they are given adequate access and insights to inform their assessment and planning.
